Sale of plot,

I am selling one plot in DHA. I have got biyana, biyana document is sign by us but buyer was away therefore he didn't sign but they gave his cheque and the money got transferred and his cousin gave me his id card copy. Are there any risks involved if biyana agreement is not signed by the seller? if they delay payment beyond the agreed final payment date will there be any problem.

Be linent in business. Other party paid you without signing and trust on you. Last month I wrote a sale deed with other party and mentioned that I will return advance amount if he wouldn't be able to pay by given time. you can define your rules

There is a saying you need some one to shave your head. You must involve a credible property dealer in a sale purchase deal to avoid similar situation.

There is one correction to my question, biyana is signed by the seller but not by buyer and he gave biyana amount what are the risks involved, if he don't pay the final amount?

no problem in that , but only hand over the covering letter (DHA will give u that on transfer day , after signing transfer docs) after recieving the full payment and go for transfer only after seeing payorder copy

There is no risk for you but risk for buyer. if he is ok without signing then no issue procede and when he will pay you full amount by Pay order then only you have to hand over him a final letter. which is called(covering Letter) without that he cant do any thing to transfer your plot on his name.and you can claim if any thing goes wrong.

If he dont pay final amount then you hold that covering letter until you get full payment. and if he with draw from deal then he cannot claim that biyana which he has given.
So dont worry and go ahead with the name of Allah.
