If buyer don't pay final amount at the agreed date than what should we do? Estate agent says that he will inform dha. I don't know what to do? I am overseas, plot is in my wife name. Biyanna I received through cheque and I don't have contact address of the buyer. estate agent says buyer is not in his office and not picking up phone. what to do?

Very strange... it is the responsibility of the estate agent to get a smooth transaction...however if the buyer doesnt pay...you own the bayana....

Contact DHA ofice, even thru help line or send them e mail and ask them the way to go forward. secondly, push estate agent and ask him what kind of clearance you need to go-ahead to sale someone else the same plot.

all consequences will be based on agreement you signed and the witness around. Verbal agreement does not have any legal values.

@baba g
you didnt sign any document and agent got money on your behalf

no sign means no deal so relax

let the buyer and agent fight among them

You will dealt as per the sale deal written and sign by you and honest and professional writes balance engagement to avoid similar situation.

I wish and pray you get out of this hassle but all ways remember to hire a credible real estate agent.

you have found yourself a bad agent. just hold on to the biyana and push him to get the payment on time. most probably yur plot is being taken by a dealer and he is struggling to find a buyer and he cannot pay yu until he finds one. if you try to sell it to someone else he will take stay order from court and you will have to go through court procedures for ages to get it cleared. in short,, you are stuck untill HE FINDS A BUYER

Please guide me, now the buyer cousin is saying that buyer has serious health problem and he cannot come to DHA for transfer of plot so what to do? He was proposing to pay 50% and balance when he recovers, which I don't agree as I have onwards commitment to pay and I don't know when he recovers. If we close the deal than what precautions should I take that there shouldn't be problem in future while selling the plot or there should be any claims from him?

You forgot to tell us that what was the agreement in writing between you and the buyer at the time of deal?

baba g replied on Tuesday, January 27, 2015 09:15 AM

Zeqe,

The buyer can get a stay on your plot and then you cannot sell the plot until stay cleared.if you want to close the deal sell the plot to somebody before he gets stay on your plot.and return him the biana.or make a case in the court as the guy is not paying as per aggreed in biana.

Zeqe replied on Tuesday, January 27, 2015 11:03 AM

It is written in the biyana that if he don't pay on time than biyana shall be forfeited and seller can sell the plot thereafter to any one and buyer shall have no rights whatso ever
