What is process for affidavit files transfers,

Lot of friends here requested me to explain the process of affidavit files. I am unable to name each friend who asked about it. Sorry about it.

In step one owner directly or via an investor hands over his 4 kanal agriculture land to DHA Lahore for getting 1 kanal plot after the ballot in that phase. This land owner or investor also agrees to pay what ever development charges that are imposed on files after ballot and before he gets possession of plot. DHA gets registry done to their name after getting it checked via legal branch that its trouble free legally and DHA takes the lands possession. It takes about 60 to 90 days time for this legal work to finish. Land owner is now entitled to have an intimation that turns into an allocation letter made in his own name or new buyers via an affidavit.



In step 2 land owners/investors find a buyer. Ask DHA on a stamp paper to issue allocation letters to new buyer. This can be done in two ways. A transfer clear affidavit is the one where file is cleared from land branch to issue intimation letters. A Cool sahib will sign a sign and affidavit without filling buyers name and land owner can find a buyer and fill his name to get affidavit transfer. This is called transfer ready affidavit file(In simple word already cleared from land branch). This is right and safer way of affidavit transfer.

In other type affidavit it is not cleared yet from land branch but buyers are lined up sellers and seller will than ask land branch to check and clear all his files at once.After file gets cleared than actual transfer will be held. Its called non cleared affidavit file. Careless or ill informed dealers/buyers use this risky route and get stuck into trouble when their cases gets stuck in land branch. Even though you will be told yes this guys this land owner gave land to DHA and entitled to 1 kanal file but file need to cleared by land branch first. You dealer never make it clear to you this affidavit must be cleared from land branch 1st. If file is missing documents or some litigation issue come to surface your affidavit intimation is held until land branch clears that file. 99 % time nothing happen.1% time you get stuck for month. Good land owners/investors dont make a deal or sell a single file until land branch clears their files for intimation making. Greedy land owners or dealers sell their affidavit before land branch OK hoping by the day transfer is done land branch will have file cleared. Now on transfer day every one started yelling at each other if files are not cleared yet from land branch.


Step 3 Land owner is issued transfer voucher for Rs 6500. Buyer pays that fee to bank. He can now take this paid voucher and his affidavit to land branch with dealer and land owner and buyer. DHA Staff normally a col there checks the file to see if any more file can be issued to land owner or he have not already used all his land given to DHA. Its done to satisfy verbally to buyer he will be issued an intimation letter against this affidavit. Col sahib will say ok leave paper work here and come back in 2 to 3 days to collect your intimation letter yourself or land if you chose land owner/investor can get it on your behalf.

Step 4 buyers or sellers collects intimation letter that is in name of buyer. Buyer now have to wait 30 days to collect an allocation letter from transfers branch free of cost. If buyer wants an urgent allocation letter can be made in 1 to 3 days by paying Rs 22000 fee.

Step 5 Buyers get allocation letter. After receiving it from transfers branch buyer pays rs 37080 associate membership fee ( Keep in mind membership fee for allocation to allocation is always Rs 22830 ). If you paid Rs 37080 it was an affidavit file.

You are now 100% sure to be in ballot. Intimation letter automatically turns into an allocation in 30 days and allocation letter is ready for ballot. If you buy an affidavit file make sure your you pay urgent fee to make it allocation letter before Wednesday May 13,2015

Price of affidavit files is always higher than allocation files but their cost of transfer is always lower than allocation files transfers. Net saving is 10000 to 20000 max in most cases. In my opinion not worth the headache you have to go through. Also you wont get any sales agreement from seller or his dealer. All you get is a receiving of pay order in sellers name. Even there 50% people are not even sellers who receive pay orders. Many market makers buy bulk files from land owner by making upfront payment so on transfer time payment pay order is in name of market maker not the actual sellers. You are out of luck if any legal or tax issue show up in this transfer.

In many cases dealers have no choice but to go for affidavit transfers. It happens a lot near ballot.All allocation files are short due no available sellers. market makers are able to buy affidavits from village people. Many times market makers have paid the land owners years ahead and only do transfers near ballots to protect them. Baba gee might get too greedy looking plots prices and give trouble in transfer . Land owners never turn their files into allocation because they get high prices and are able to avoid TAX department too after sale. Buyers demand prefer affidavit when files are in large amount especially commercial plots transaction because they also save big amounts of CVT etc. If commercial affidavit are already cleared from land department deals are very smooth and risk free. Also try your best to make pay order in name of seller to largest possible amount if not all of the amount. All these term of deal must be discussed before deal in finalized. Normally uneducated s land owners say putter tenoon tey plot chai da ay teenon ke lagey check meno maley ke ke investor noon. Trying your best to get land owner sign copy of pay order even if its in name of market maker.

Once again forgive my poor English. I dont know how you guys are able to ready. My son always complain after is send him 160 letters SMS. he always call back Daddy what you just sent me I can understand a single work of it

I follow this forum regularly and gets very valuable professional opinions and ideas from all the respectable participants especially from your posts, as you're the most wanted person on earth here. People love you. I'm in NJ; yr breaking news of balloting is very encouraging. Looks like you work so long hours and I wonder how you get some rest if any. I enjoy yr witty quote.. Yesterday I filled in LRE form online with my Allocation Letters Nos. and paid up Membership Rs.22830/- each for 2 files of 1K.(Ph-9).
Hope LRE got it. Will appreciate confirmation please.

Thanks Tahir Chaudhry bhai so kind of you. We need just 2 to 3 working days to check from DHA office. Will get back to you after check and also with ballot results

I did use to get a good 5 hours sleep before but now Its shrunk to only 4 hours during this week :)

Thanks for detailed reply, there were many things even unknown to me, I am always in Hurry in Pakistan and taking your advice years back once I went for a allocation file and transfer was smooth like a plot and all money paid to owner,
Looking at this process of affidavit, there are so many cards not with Buyer but seller as well, no matter how vigilant and clever buyer is there can be issues especially when market is hot and price is changing every few hours.
I bought a file in Cold Market at that time I came to know

!. File Prices though given as "Gold Rate" are not accurate, and there is bargain of 1 to 2 Lac, 33 Lac File I Got in 31.50.
2. I had to wait for few days to find bargain rate but dealer was offering from the first day affidavit file at 31.25 but I was interested in getting allocation.

Can you give comments about bargain in file price and why affidavit was available Cheaper or easily where as you told opposite.

Mostly affidavit are priced higher but their transfer cost is lower.

Every once in while a big seller come to market to sell all his files because all are cleared on one day. Actually some times many land owner get multiple files cleared on same day. Its habit of allmost every land owners to sell their cleared affidavit files right away asap evwn in same day. They never saw this kind of miney before. They come to DHA on Yamaha but want to go home in camery. Just kidding.

Oversupply due to clearance on same day drive their price lower than allocations. Before people were very uncomfortable with affidavit files but now its most sought after due to tax non documentation no CVT etc abd lower net transfer costs.

Dear CMY Sb,
Thanks for this valuable information.Please clarify, what is the right time(at which step of transfer process) to make final payment in case of affidavit transfer.
Moreover, is there any possibility, seller (owner) could go with anther buyer after depositing the transfer fee incase he gets better offer from that buyer.
